Administrative - contravention liability of the legal entity

The framework regulation of contravention liability expressly stipulates the contravention liability of the legal entities as well. Therefore, according to the provisions of article 3, par 2 of the Governmental Ordinance no. 2/2001 regarding the legal status of contraventions as further amended and completed, the legal entity is liable from contravention point of view in the cases and under the conditions provided in the normative acts that establish and punish contraventions. The administrative-contravention liability of the legal entity operates as an exception and derogation, in comparison to the liability of natural persons, only if there is an express legal provision, which is not requested in the case of the individual subjects of law for the regulations that apply to them. The main contravention penalties that apply to legal entities are warning and fine.
