On September 4, 2007, EPA proposed regulations to address the residual risk remaining after implementation of the 1995 maximum achievable control technology (MACT 1) standards for petroleum refineries. The proposed rule sought public comment regarding implementation of a fenceline monitoring requirement for benzene based on EPA’s concerns of low bias for reported refinery hazardous air pollutant (HAP) emission data. Public hearing comments reflect support for a fenceline monitoring program. Additionally, comments submitted by the National Association of Clean Air Agencies (NACAA) call for fenceline monitoring programs in the final rule. Finally, a review of the docket indicates that EPA has given detailed consideration to fenceline monitoring programs for benzene at petroleum refineries.
