One especially sensitive issue in the FTA negotiation was intellectual property. Aspects negotiated included patent scope, compensation for expiration date of patents due to unjustified delays, test data protection, adherence to international treatiesand conventions, and solution of controversies. The objective of the present study is to establish the impact of approval of the chapter on intellectual property in the FTA on USA-Peru. This impact would be on the market of products for protection of agricultural crops and aquaculture. In particular, we are interested in the impacts of a system of test data protection in registration procedure of pesticides.
