STATE LEGISLATIVE APPROACHES TO AUTOMATED VEHICLES: A REVIEW AND ANALYSIS

As of May 2014, four U.S. states have passed legislation pertaining to automated vehicles: Nevada, Florida, California, and Michigan. It is anticipated that robust discussions will be necessary and beneficial in developing consensus regulatory approaches that allow for broad adoption of automated vehicle technologies. This paper serves mainly to compare and contrast the four initial state-level automated vehicle laws. The laws are also compared and contracted in an attempt to determine the implications of the various legal approaches. A key finding is that legal definitions in these laws are sub-optimal. Additionally, we observe that some legislative approaches may introduce unnecessary complications in the development and deployment of automated vehicle technology.
