In the world of small businessperson, business and personal information is much likely to bestored and processed on the same information technology (IT) platform. Should the smallbusinessperson’s IT resources ever be subjected to a forensic investigation, unrelated personalinformation will almost certainly be included, whether appropriately or not. Yet, should thesubject of the investigation have encrypted their personal data to protect it, there will probably bea perspective by forensic investigators that the individual is attempting to hide relevantinformation. It is this “presumption of guilt” that this paper attempts to understand. We present atheoretical framework to help explore the issues related to “presumption of guilt” syndrome.
