U.S. patent law determines patent rights that can profoundly affect companies' bottom lines. This paper outlines the standard for patentability, discusses the types of evidence used to determine whether the standard has been met, and shows how the standard has been applied to water treatment technology. It also describes the rights accorded by patent, presents an analytical framework for assessing patent rights, and summarizes the do's and don'ts of good invention management.
