Tunneling had stopped on one of the four Brightwater tunnels. King County negotiated a new contract (cost-reimbursement plus fixed fee) with Jay Dee /Coluccio JV, the Contractor that was just completing the Brightwater West Tunnel. In order to meet schedule constraints, the contract was negotiated in just five weeks, demonstrating the effectiveness of a “partnering” approach to solve difficult tasks. During the time the negotiations were underway, the Contractor began work on preliminary tasks on the assumption that the negotiations would be successful. Following contract execution, the Contractor negotiated new subcontracts and supply agreements for the new work and also coordinated with affected subcontractors on the remaining West contract work, which had to be delayed until after the BT-3 tunnel was completed. Following contract execution in mid-April 2010, the contractor re-built the TBM to address the expected conditions on the BT-3 tunnel. Mining of the BT-3 tunnel commenced on schedule in late September 2010. This paper discusses the contract negotiation process, the key considerations for each party, and the challenges that were overcome in order to get the work underway in a timely manner.
