The Metropolitan Government of Nashville and Davidson Comity (Nashville) entered into a Consent Decree (CD) with The United States Department of Justice (DOJ). United States Environmental Protection Agency (EPA) and The State of Tennessee that was judicially executed on March 12. 2009. The Consent Decree ends civil litigation and enables Nashville to continue their program of infrastructure improvements to reduce overflows to the Cumberland River that was begun in the early 1990s. This paper presents four factors that helped shape a successful Long Term Control Program (LTCP) for Nashville - effective application of EPA's Nine Minimum Controls (NMC). comprehensive system characterization and modeling, evaluation of alternatives in a water quality context, and the ability to exercise the force majeure clause in the consent decree.
