CSO Control in the Music City – Nashville’s Plan to Improve Water Quality of the Cumberland River

The Metropolitan Government of Nashville and Davidson County (Nashville) entered into aConsent Decree (CD) with The United States Department of Justice (DOJ), United StatesEnvironmental Protection Agency (EPA) and The State of Tennessee that was judiciallyexecuted on March 12, 2009. The Consent Decree ends civil litigation and enables Nashville tocontinue their program of infrastructure improvements to reduce overflows to the CumberlandRiver that was begun in the early 1990s. This paper presents four factors that helped shape asuccessful Long Term Control Program (LTCP) for Nashville – effective application of EPA’sNine Minimum Controls (NMC), comprehensive system characterization and modeling,evaluation of alternatives in a water quality context, and the ability to exercise the force majeureclause in the consent decree.
