The emergence of performance-based design in the United States creates challenges both for the design community and the regulatory community. In both communities, the technical requirements for performance design requires specialized education and experience. The burden placed on the regulatory industries include the increasing demands placed on current staff and the limitations on locating and hiring staff which have the necessary credentials. Also, the performance design process requires more participation of the regulatory officials in the early stages of the design. The review process cannot wait until after construction documents have been submitted. This also requires additional resources and manpower. In many jurisdictions, more than one agency has legal responsibilities in the enforcement of codes and standards. This also places an additional demand on local jurisdictions to manage all parties involved on the regulatory side.
