A system and a method for controlling congestion of a mobile communication network having a base station and an RNC(Radio Network Controller) are provided to improve a congestion control algorithm by determining a priority level according to an amount of non-real time data, and differentially reducing a transmission rate according to the priority level when there are multiple non-real time data. A base station(102) includes a load measuring unit(110) for measuring a load of total power transmitted to a terminal. An RNC(104) interworks with the base station through a mobile communication network.
