An overflow preventive valve with an elastic orifice tube and an overflow preventive system using the same are provided to exclude complex parts by using the orifice tube flexible according to the flow rate of a fluid and forming a variable passage. An overflow preventive valve with an elastic orifice tube and an overflow preventive system using the same includes a pipe coupling casing(110) and an orifice tube(120). The pipe coupling casing is coupled to a pipe and has a chamber and an introduction opening and a discharge opening for introducing and discharging a fluid into and from a chamber. The elastic orifice tube is accommodated in the chamber. An orifice hole(121) for passing the fluid introduced through the introduction opening of the casing is formed in the orifice tube. The pipe coupling casing includes a plurality of chambers, introduction openings, and discharge openings. The orifice tube is accommodated in the chamber. As the flow rate of the fluid passing through the orifice hole increases, the pressure applied to the inner peripheral surface of the orifice tube decreases to reduce the cross-sections of the orifice tube and the orifice hole.
