An apparatus and a method for processing data stream in a digital set-top box are provided to calculate an availability of CPU by a set period and to judge that stream data is not received accurately when the calculated availability of CPU is lower than a set availability of CPU, thereby generating a key event to receive a new stream from a VOD server and recovering the screen breakdown forcibly. A VOD content is selected by key input(S101). A stream data of the content data is received from a VOD server through a network(S102). It is judged whether a media player is operated(S103). When the media player is not operated, the VOD player operation is finished(S104). When the VOD player is operated, availability of CPU is checked(S105). It is judged whether a digital set-top box is in a play mode(S106). When the digital set-top box is not set in the play mode, the availability of CPU is checked, and when the play mode is set, the number in which the calculated availability of CPU is lower than the pre-set availability of CPU(S107). It is judged that the counted number exceeds the set reference number(S108). When the counter number exceeds the set number, a key event for asking for stream data resend is generated(S109). The stream data is replayed(S110).
