PPROBLEM TO BE SOLVED: To accurately discriminate whether an image to be discriminated is a back light image or not. PSOLUTION: The discrimination apparatus comprises a histogram data generation section, an attribute information acquisition section and a discrimination section. The histogram data generation section generates data of histograms by colors representing the number of pixels corresponding to a density value of each color in a pixel constituting an image to be discriminated. The attribute information acquisition section divides an area represented by the histogram by colors into three or more small areas by magnitudes of density values, respectively, selects at least one of the three or more small areas by colors as a first small area, selects at least one of the three or more small areas by colors as a second small area of which the density value is greater than that of the first small area and which is not adjacent to the first small area, and acquires attribute information regarding these first small area and the second small area by colors. The discrimination section discriminates whether the image to be discriminated is a back light image or not based on the acquired attribute information regarding the first small area and the second small area by colors.
