The vehicle (1) has a folding top (2) i.e. soft top, and a determining device for determining a contact of the folding top and for determining approximation to the top. The device has a capacitive sensor (3) and an evaluation unit (4) coupled with the capacitive sensor. The evaluation unit determines change of electrical capacity (C) of the sensor. The capacitive sensor is formed from a metallic element i.e. frame (2.1), of the folding top, where the folding top is electrically isolated from a body (1.1) of the vehicle completely. The folding top is formed from textile fabric and/or plastic.
