PURPOSE: A day and night determination apparatus and a day/night determination method are provided to determine day and night precisely by comprehensively analyzing object information which is obtained through radar and an image obtained through a camera.;CONSTITUTION: A day and night determination apparatus comprises a camera(104), radar(106), and a controlling unit(102). The camera aims to obtain an image of a vehicle periphery. Radar aims to obtain object information of the vehicle periphery. The controlling unit determines day and night by analyzing an image of a remaining area except for the image of the area corresponding to an object, which is obtained through radar from the image obtained through the camera.
