A mobile terminal having a touch screen and a method for providing the touch screen function using a touch pen therein are provided to enable a user to diversely change and use a menu function according to the type of his touch pen by providing various functions according to the types of touch pens using short range communication. A mobile terminal is comprised of a touch pen and a main body(200). The touch pen comprises the first short range communication module. The first short range communication module, such as an RFID(Radio Frequency Identification) tag, stores specific information. The main body, composed of the second short range communication module(210) and a touch screen(220), reads the specific information, stored in the first short range communication module, through the second short range communication module and activates an operation mode equivalent to the specific information. In this case, the second short range communication module is an RFID reader.
