An apparatus for improving download speed of data in a data broadcasting and a method thereof are provided to improving application and downloading speed by using idle tuner. An apparatus for improving the download speed data in data broadcasting comprises a channel searching part(120), and a download performing part(130). If channel change is detected, the searching part decides whether the changed channel is a boundary channel or not. If the channel is a boundary channel, the data is downloaded through an idle channel by the download performing part.
