Various embodiments manage a conditional negative acknowledgment (NACK) procedure on multi- subscriber identity module (SIM) wireless communication devices. The wireless communication device may detect an active data communication in a first network on a modem stack associated with the first SIM, and detect an upcoming tune-away period associated with the second SIM in which the timing of the upcoming tune-away period conflicts with the active data communication. The wireless communication device may identify a code rate for downlink data in the data communication on the first SIM. If the code rate is lower than a preset code rate threshold, the wireless communication device may continue normal hybrid automatic repeat request (HARQ) processes for downlink data in the active data communication on the first SIM. If the code threshold is not lower than the preset code rate threshold, the wireless communication device processor may implement a deliberate NACK procedure.
