The present invention relates to a situation-based operation determination apparatus, a vehicle capable of situation-based operation determination, a situation-based operation determination method and a method of controlling the vehicle which can quickly and properly provide a user with a recommendation operation. The situation-based operation determination apparatus comprises: a situation information acquisition unit to acquire situation information; a database for situation recognition constructed by using data related to previously performed operations; a processor to determine a recommendation operation and a recommendation index corresponding to the recommendation operation based on the situation information and data acquired from the database for situation recognition, verify the recommendation operation, and determine a final operation in accordance with a verification resu and a selection history database constructed by using the final operation, the recommendation index and an actually performed operation while the final operation is suggested. The processor can verify the recommendation operation by using the selection history database.
