Annual Compliance Statement 2016 and Board of Directors / Governing Body and Corporate Governance Requirements: Section 39 providers

In 2016 the HSE (the Executive) provided funding of €3.6bn approximately to circa 2,300 agencies for theuddelivery of a range of health and personal social services, of which approximately €0.714bn was provided toud310 Section 39 agencies (hereafter referred to as the “Provider”) who were in receipt of funding in excess ofud€250,000.udTo underpin the funding received, these Providers are required to enter into a formal Service Arrangement withudthe Executive. The Service Arrangement is the contract between the Executive and each individual Providerudand comprises the Part 1 general terms and conditions of the Service Arrangement and the Part 2 Schedulesudprepared on an annual basis that specify the services to be delivered, budget, staffing, quality and safetyudrequirements, monitoring requirements, etc. for each separate funding arrangement under the ServiceudArrangement. Providers are obliged under this Service Arrangement to give certain undertakings in relation toudcompliance with a range of standards and statutory requirements.udGiven the level of investment by the State in services provided by the non-statutory sector, each Section 39udProvider Board of Directors / Governing Body in receipt of €3m, or greater, funding from the Executive must, inudrespect of the Service Arrangement for 2016 and subsequent years:ud Submit a formal Annual Compliance Statement as set out in Part 1 of this document, andud Adopt and implement core governance standards as set out in Part 2 of this document.udSubmission of the Annual Compliance Statement will form part of the consideration of ongoing funding forudeach Provider.
