摘要

South Africa has recently announced that it will amend its new patent legislation to allow for the use of parallel importation and compulsory licensing rights provided by international agreements. Commenting on responses to a public consultation on the government's proposed National Policy on IP, Trade and Industry Minister, Rob Davies, said, "Although we've been a major champion of all these processes internationally we haven't necessarily incorporated them into domestic law. That's one of the issues that we need to follow through."
