Natural Gas Regulation: FERC Required Forms Administrative Law: Scope of Judicial Review: Rulemaking

In February 2007, FERC opens an inquiry to determine whether its extant financial forms are sufficient to provide information to the public about the pipeline's jurisdictional rates. FERC no longer reviews rates triennially as it once did and thus relies on investigations and complaints by third parties as the basis for any determination as to whether an existing rate is "unjust, unreasonable, unduly discriminatory or preferential." This leads to the FERC proposing and then changing its rules as to the forms that need to be filed by jurisdictional pipelines partially in order to deal with the issue of fuel costs being charged by the pipelines. A new schedule is added to Forms 2, 2-A, and 3-Q requiring pipelines to report detailed information regarding the acquisition and disposition of shipper-supplied gas.
