Heavy FERC Enforcement Forecast in Electric Area

Over the last several years, the Federal Energy Regulatory Commission (FERC) has ag-gressively pursued its enforcement authority that was significantly enhanced through enact-ment of the Energy Policy Act of 2005 (EPAct 2005). FERC can now impose fines of up to 1 million a day for violations of the Federal Power Act (FPA), increased from 10,000 a day.
