The U.S. Department of Labor/Wage and Hour Division conducts investigations under the Migrant Seasonal Protection Act (MSPA) each year in the mushroom industry. The most cited violations in the past have been failure to disclose conditions to the workers and using services of an unregistered Farm Labor Contractor (FLC). A civil money penalty may be assessed for these violations. During investigations being conducted this year, the Wage and Hour Division will also be focusing on joint employment of workers. If you are found to be a joint employer with an FLC or another company, you may be cited for any violations disclosed and liable for back wages and/or penalties.
