This article assesses how, and with what success, the government has sought to address drafting glitches and possible pitfalls identified by the author when the Transfer of Undertakings (Protection of Employment) Regulations (TUPE) 2006 were in their draft form. The author examines the definition of a relevant transfer; changes to terms and conditions; constructive unfair dismissal; clarification for the reasons for dismissal; insolvency; notification of liability information; failure to consu and liability for personal injury claims in the public sector.
