On December 23, 2010, a Ninth Circuit panel (Panel) issued a ruling that operators will find instructive with respect to designing and implementing storm water control and management measures at mine projects. In Greater Yellowstone Coalition v. Lewis, 628 F.3d 1143 (9th Cir. 2010), the Panel affirmed the district court's rejection of claims brought by environmental interest groups (Groups) against federal agencies (Agencies) over approval of a mine expansion project.
