The case of KH and others v Slovakia is the first in a series of cases before the European Court of Human Rights (ECtHR) dealing with the subject of coerced sterilisation. The case deals not with the legality of the sterilisation, but with the subject of personal data and effective access thereto. By applying Article 8 of the European Convention on Human Rights (ECHR), the ECtHR expands on the right to respect for private and family life as encompassing informational rights. By formulating two conditions of the right to effective access to medical information under Article 8, it reinforces the human rights protection of data of a personal and specific nature.
