MIDWESTERN GAS MUST TWEAK ITS TARIFF SOME MORE TO COMPLY WITH EXISTING POLICIES ON CURTAILMENT CREDITS, RIGHT OF FIRST REFUSAL/EVERGREEN PROVISIONS, SERVICE TIMELINES, AND RESERVATION OF CAPACITY FOR EXPANSIONS

Midwestern Gas Transmission Co. (RP11-2254) was told by FERC to make more changes to its tariff records filed last July to make housekeeping changes and substantive changes. Last summer, the Commission accepted and suspended the revised tariff records to become effective 1/1/12 or an earlier date set forth in a subsequent order, subject to refund and conditions. It also directed Midwestern to file a response to the issues raised by the parties concerning its proposed changes within 20 days from the issuance of the July 29 order. (FR No. 2859, pp36-37) On August 18, Midwestern filed to comply. The Commission on 12/30/11 accepted the revised records filed July 1, with the changes Midwestern proposed in its August 18 filing, subject to further revision and conditions. FERC will permit the tariff records "as further revised" to become effective 1/1/12. Midwestern's filing to comply with this order will not be due for another 30 days from the date of the order.
