TUSCARORA GAS ASKS FERC TO REJECT PUBLIC UTILITIES COMMISSION OF NEVADA's AND SIERRA PACIFIC POWER CO.'S REQUEST FOR INTERIM RATE RELIEF

On 9/1/11, Tuscarora Gas Transmission Co. replied to the comments(RP11-1823, et al) on its cost and revenue studies and asked FERC to deny the requested interim rate relief filed by the Public Utilities Commission of Nevada (PUCN) and Sierra Pacific Power Co. d/b/a NV Energy (collectively, “complainants”). Tuscarora maintains that FERC “lacks authority” to provide the relief since the Commission may only issue an interim rate order under section 5 of the Natural Gas Act (NGA), “after it has conducted an adversarial, adjudicative- type hearing.” Thus far, Tuscarora has filed cost and revenue studies which demonstrate that, when appropriate adjustments are incorporated, its existing rates are in fact lower than is warranted. Moreover, complainants have yet to demonstrate that (1) Tuscarora's existing rates are unjust and unreasonable, and (2) the complainants? proposed rates are just and reasonable.
