FERC Affirms Rockies Express Pipeline’s Potential Transactions Do Not Trigger the Most Favored Nations Rights of Rockies’ Foundation and Anchor Shippers
On 11/26/13 FERC granted a Rockies Express Pipeline’s (RP13-969) petition and affirmed that its potential one-zone transactions east to west do not trigger the Most Favored Nations (MFN) rights of Foundation and Anchor Shippers on the pipeline. Rockies Express filed a petition for declaratory order last June seeking a ruling specifically that the MFN rights of its Foundation and Anchor Shippers will not be triggered by potential transactions with other shippers for firm transportation which have (1) an east to west primary path, (2) a term of one year or longer, and (3) service in only one rate zone. The Commission affirmed on all accounts.
