FERC Rejects Rehearing of Order Dismissing Complaint Lodged by Western Companies Against TEPPCO but Elaborates on Primary Jurisdiction Doctrine for Oil Pipelines
On 10/22/09 FERC rejected a joint request for rehearing and upheld a June 22 order dismissing a complaint filed by Western Refining Southwest, Inc. and Western Refining Pipeline Co. (Western Parties) against TEPPCO Crude Pipeline, LLC (OR09-3). The order dismissed the complaint because it was considered by the Commission to involve a private contract not within the Commission's jurisdiction. Since the order dismissed the complaint, the order also denied a motion to intervene and request to consolidate filed by Resolute Natural Resources Co. and Resolute Aneth, LLC. Requests for rehearing were filed by the Western Parties and Resolute. Both requests for rehearing were denied.
