Emerald Coal Tried Again but Failed to Link Northern Bridge Gas Project with Texas Eastern's Other Building Programs in Effort to Protect Mining Operations

A FERC order, issued 5/21/09, rejected the January 16 rehearing petition of Emerald Coal Resources, LP who sought to block any intrusion on its mineral extraction activities by Texas Eastern Transmission, LP (CP08-100). Emerald contended that the Commission, in weighing approval of the Northern Bridge Project, failed to give adequate consideration to the potential for "subsidence" under Texas Eastern's existing pipeline facilities as the result of Emerald's planned coal mining operations in an area crossed by the pipeline.
