Florida Gas Pledges Cooperation with Florida Transportation Department But the Department's Petition to Show Cause Is Three Years Too Late, FGT Answers

Florida Gas Transmission Co. (FGT) (CP06-9) quickly blasted the recent protest, motion for order directing compliance, motion for order to show cause, and request for expedited treatment filed by the Florida Department of Transportation (FDOT). FGT called FDOT's filing "an improper request for rehearing of final Commission orders" which is barred by section 19 of the Natural Gas Act (NGA). FDOT "lacks standing to request that the Commission require an interstate natural gas pipeline to abandon a section of its system. That ability to seek authorization for abandonment of certificated facilities lies solely with the jurisdictional pipeline." At some point, the pipeline complained, "an end to wasteful and repetitive filings must be ordered to conserve the resources of the Commission and the parties."
