Arena Energy Renews Allegation, Supported by Hess, Apache, ExxonMobil, That Sea Robin Misused Boilerplate Tariff Provisions in Order to Frustrate the Intent of a Discounted Rate Contract

Arena Energy, LP (RP10-1045), author of a complaint filed at FERC on August 2, alleging that Sea Robin Pipeline Co., LLC had breached an interruptibie transportation service (ITS) by terminating a contract with Arena, effective 5/31/10, said that Sea Robin misplaces its reliance on the pro forma, general provisions of the tariff over the specific negotiated discounted rate agreements between Arena and Sea Robin. Sea Robin thus is ignoring the general principles of contract interpretation followed by the Commission.
