EPA Publishes Proposal to Dramatically Increase Thresholds for Permitting Large Industrial Facilities That Emit Greenhouse Gases; This Rule Is Required by Pending 'Endangerment Finding' under Clean Air Act

The Environmental Protection Agency (EPA) issued a proposed rule, Prevention of Significant Deterioration (PSD) and Title V Greenhouse Gas Tailoring Rule, necessitated by the imminent adoption of rules to control greenhouse gas (GHG) emissions on grounds that they are air pollutants covered under the Clean Air Act (CAA). The text of the proposal and a request for comments appeared in the 10/27/09 edition of the Federal Register. Comments are due December 28.
