Conditions Authorizing Weaver's Cove Original Liquefied Gas Project Scrutinized by FERC; Only State Court and Transportation Department Can Resolve Certain Issues

The Commission on 10/21/10 addressed two sets of conditions in orders authorizing the original liquefied natural gas (LNG) terminal proposed by Weaver's Cove Energy LLC (CP04-36) in Fall River, Massachusetts, under section 3 of the Natural Gas Act (NGA). The City of Fall River and the Commonwealth of Massachusetts (collectively, Massachusetts) requested rehearing of certain findings underlying these conditions. There have been several efforts to kill this project, including preservation of a bridge too low to enable supertankers to reach the original site. Most recently, Congress extended federal environmental protection under the Wild and Scenic Rivers Act to the lower Taunton River, which the tankers would be forbidden to traverse.
