摘要

'Best interests' is a term that is often misunderstood and incorrectly applied in practice. This article is the first of three dedicated to an explanation of the legal principles and practical applications of the term when applied to the provision of treatment and care of patients. Elements of the debate are explored that relate to aspects of daily treatment and care and to circumstances where the issue(s) relate to end of life considerations. This first article aims to raise awareness of issues that relate to the idea of acting in a person's best interests. Potential areas of concern and apprehension on the part of healthcare providers are reviewed with the aim of preparing the reader for the more legally concentrated second article, and further to alert the reader to the possibility of uncomfortable reflection to be undertaken in a professional vein.
