I greatly enjoyed 'Going legal' by Lopez et al,1 and endorse the article's main conclusions. While the authors' assertion that 'The (Mental Capacity) Act does not allow actions which will involve the deprivation of liberty in those aged 16 or 17' is a fair reflection of that statute's starting position, it does not tell the whole story, and this detail would have had a significant effect on the clinical case.
