Competition policy

The Competition Commission and the Competition Tribunal implement South African competition policy-unlike some other jurisdictions where a single entity investigates and adjudicates. The competition institutions, set up by the Competition Act (No. 89 of 1998), began operating in 1999. The Competition Commission investigates and evaluates prohibited practices and exemptions, implements measures to enhance market transparency, authorises or prohibits intermediate size mergers and makes recommendations about large mergers to (and investigates matters referred to it by) the Competition Tribunal. The tribunal in turn authorises or prohibits large mergers, reviews prohibited intermediate mergers upon appeal and adjudicates issues of prohibited conduct or practices or merger activity.
