The commission remanded to an ALJ a request by American Coal Co. to reopen final civil penalty assessments. The operator stated that it failed to contest some proposed assessments because of personnel changes in its in-house legal department at the time it received MSHA's proposed assessment sheet covering citations issued in 2006 and 2007. MSHA did not oppose reopening the assessments, but pointed out that three of the proposed penalties have been paid.
