Construction Act-the next step

The Act received Royal Assent in July 1996 and applies to all contracts with construction type obligations (including highways maintenance). It is not possible to contract out of the Act so its effect has to be considered in relation to each contract in a road PPP project. The burden is on the DBFO Co and the Operator to ensure their contractual arrangements which fall within the scope of the Act are compliant with the Act and any failure may result in the Scheme overriding the contract.
