Expert Focus: Surveying the EU’s new market surveillance Regulation

The provisions of the EU's Regulation on market surveillance and compliance of products will start to apply from 1 January 2021. Tom d’Ardenne, senior associate at Global Environmental and Regulatory Law Group Allen & Overy, investigates its implications. Regulation (EU) 2019/1020 on market surveillance and compliance of products will have a direct impact on 70 designated pieces of EU legislation, including key regimes such as REACH, CLP, RoHS and WEEE. It will also reboot the framework used to control how non-EU products cross the EU’s external borders. Its provisions will start to apply from 1 January 2021, with the key obligations for economic operators applicable from 16 July 2021.
