For the third time in five years, proceedings have been filed against the United States in the International Court of Justice alleging violations of the Vienna Convention on Consular Relations (Vienna Convention). The Convention provides that foreign nationals must be notified of their right, to communicate with consular officials when they are detained by law enforcement officials in member states. In Avena, Mexico instituted proceedings against the United States, alleging violations of the Vienna Convention in fifty-four separate cases involving Mexican nationals who had been convicted and sentenced to death. And for the third time in live years, the International Court of Justice has issued a provisional measures order, indicating that the United States must lake all measures necessary to ensure that certain foreign nationals are not executed pending the Court's final judgment in the case.
