First successful appeal under Sentencing Council guideline

The Court of Appeal has reduced a company's fine for health and safety breaches by 50 per cent, in the first successful appeal against a sentence under the Sentencing Council guideline in force since 1 February 2016 (for more detail on the guideline see page 1), MJ Allen Holdings Limited pleaded guilty to breaching Regulation 6(3) of the Work at Height Regulations 2005 and was fined ?160,000 and ordered to pay costs of ?5,767 by Canterbury Crown Court in April 2016. The court was told that a maintenance supervisor using an unsafe method of work slipped and almost fell through the fragile roof of the company workshop on 19 September 2014.
