In June 2003, the Cooks and others convey the surface estate on a 320-acre tract of land to the Archer Trusts. A second instrument transfers a right of first refusal (ROFR) or a preferentialright to purchase for the reserved mineral estate should the Cooks or their successors in interest choose to sell the mineral estate to a bona fide buyer. Later in 2003, the Archer Trust notes that the ROFR instrument has & description error in that it refers to the tract of land being in Ochiltree County while it should have read Hansford County.
