On January 15, 2020, the Federal Permitting Improvement Steering Council (FPISC), an entity created under the Fixing America's Surface Transportation Act (FAST Act), Pub. L. No. 114-94, 129 Stat. 1312 (2015), added non-energy mining to the list of projects eligible for streamlined permitting under the FAST Act. The FAST Act was signed into law in 2015 and was designed to improve the timeliness of permit reviews for certain covered infrastructure projects. Title 41 of the FAST Act (FAST-41), 42 U.S.C. §§ 4370m to 4370m-12, created the FPISC, composed of administrative agency deputy secretary-level members and chaired by an executive director appointed by the president, and established new procedures that standardize interagency consultation and coordination practices.
