EPA to Regulate Oil and Gas UIC Wells in Idaho As of July 30, 2018, the U.S. Environmental Protection Agency (EPA) is administering the permitting and enforcement program for Class II underground injection control (UIC) wells throughout Idaho. See State of Idaho Voluntary Transfer of Primacy of the Class II UIC Program to the EPA, 83 Fed. Reg. 36,433 (My 30,2018) (to be codified at 40 C.F.R. pt. 147, subpt. N). Idaho's primary oil and gas producer has been disposing of produced waters from oil and gas wells by trucking them over 60 miles to evaporation ponds south of Boise. Some hope this recent action by EPA-which was at the request of the State of Idaho-will reduce production costs and therefore promote additional oil and gas development within the state.
