In Menominee Indian Tribe of Wisconsin v. EPA, 947 P.3d 1065 (7th Cir. 2020), affg 360 F. Supp. 3d 847 (E.D. Wis. 2018), the U.S. Court of Appeals for the Seventh Circuit affirmed the U.S. District Court for the Eastern District of Wisconsin's dismissal of the Menominee Indian Tribe of Wisconsin's complaint against the U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (Corps), and denial of the Tribe's request to amend its complaint. Aquila Resources, Inc. (Aquila), which intervened in the Tribe's lawsuit at the district court level, applied for and ultimately obtained a wetland permit from the State of Michigan.
