Sunoco Relents, Withdraws Right-of- First-Offer Provision for New Shippers in Transportation Agreement, in Wake of Protest from Liquids Shippers Group; Shippers Drop Protest

Sunoco Pipeline LP (OR15-18) will withdraw a request for FERC’s approval of a Right of First Offer (ROFO) provision included as part of the pipeline’s Feb. 23 Petition for Declaratory Order (PDO) for the construction of the 130-mile Delaware Basin Extension project (FR Nos. 3039, pp9-10; 3044, pp29-33). In the wake of a March 23 protest filing from the Liquids Shippers Group, Sunoco said it will remove the measure “in the interests of simplifying the issues in this proceedings and facilitating the expeditious approval of the remaining issues in the PDO” so that Sunoco can proceed with construction of the extension.
